Quebec Tobacco Act - Summary
The
Act to amend the Tobacco Act attacks the problems of widespread
tobacco retail outlets and direct and indirect tobacco advertising,
and takes measures to better protect Quebecers’ health from the
dangers of exposure to second-hand smoke. The measures
come into effect on May 31, 2006, except as noted.
The
Tobacco Act:

Prohibits
smoking in bingo halls, bars, pubs, taverns, restaurants,
shopping malls, bowling alleys, pool halls, convention centres,
and other recreational centres;
-
Prohibits
smoking in taxis and other vehicles that transport two or more
people and that must be used as part of a job;
-
Prohibits
smoking on the grounds of childcare centres and primary and
secondary schools during the hours when childrenor students are
present (as of September 1, 2006);

Prohibits
anyone, not only merchants, to sell tobacco to a minor;
-
Increases
penal and administrative penalties for the sale of tobacco to a
minor;

Restricts
tobacco retail outlets are to closed, fixed locations;

Prohibits
tobacco displays from May 31, 2008, in nearly all tobacco retail
outlets. Although duty-free shops
are exempted, as are cigar halls and other specialized shops in
operation on May 10, 2005, the government may regulate displays
to limit the exposure of tobacco products in these areas;

Prohibits
tobacco retail outlets in the following locations: premises on
which sporting, cultural, artistic, or leisure activities occur;
Cégeps and universities; restaurants;
bars, pubs, and taverns; and

Prohibits
objects other than tobacco products and on which a name,
drawing, logo, or distinctive sign related to
tobacco appears.
